1. Agreement to Terms

By accessing or using AI AWARE™ ("Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our Service.

Age Requirement: You must be at least 13 years of age to use AI AWARE™. By using the Service, you represent that you meet this age requirement.

2. Description of Service

AI AWARE™ provides tools and services to help users identify AI-generated, manipulated, or synthetic content in digital media, including:

• Text analysis for AI-generated content detection
• Image analysis for deepfakes and AI manipulation
• Video analysis for synthetic media detection
• Audio analysis for voice cloning detection (when available)
• Real-time scanning and risk assessment

Important: AI AWARE™ is a detection tool designed to assist your judgment, not replace it. Results should be used as one factor in your decision-making process.

3. Account Registration and Security

3.1 Account Creation

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Payment Terms

4.1 Merchant of Record

All payments are processed by FastSpring, our Merchant of Record. FastSpring handles billing, VAT/tax calculations, and refunds on our behalf.

4.2 Subscriptions

• Auto-Renewal: Subscriptions automatically renew unless cancelled before the next billing cycle
• Cancellation: You can cancel anytime through your account settings or by contacting FastSpring
• No Refunds for Partial Periods: Cancellations are effective at the end of the current billing period

4.3 Price Changes

We may change subscription prices at any time. Price changes for existing subscribers will be communicated at least 30 days in advance and will take effect at the next renewal.

5. Acceptable Use Policy

5.1 Permitted Use

You may use AI AWARE™ for:

• Personal protection against AI manipulation and scams
• Verifying authenticity of content you receive
• Educational purposes related to AI awareness
• Professional content verification (journalism, research)

5.2 Prohibited Activities

You agree NOT to:

• ❌ Use the Service for any illegal purpose or in violation of any laws
• ❌ Harass, abuse, threaten, or harm others
• ❌ Reverse engineer, decompile, or attempt to extract source code
• ❌ Circumvent any security features or access restrictions
• ❌ Use automated scripts or bots to access the Service (except authorized API use)
• ❌ Overload or interfere with Service infrastructure
• ❌ Resell, redistribute, or commercially exploit the Service without permission
• ❌ Upload malicious code, viruses, or harmful content
• ❌ Impersonate any person or entity
• ❌ Collect or harvest user information without consent

5.3 Consequences of Violations

Violations may result in immediate termination of your account, reporting to law enforcement if applicable, and legal action.

6. Intellectual Property Rights

6.1 Our Intellectual Property

AI AWARE™, including its name, logo, design, code, algorithms, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works
• Use our trademarks without permission
• Remove copyright or proprietary notices

6.2 Your Content

Content you submit for scanning (text, images, videos) remains yours. We do not claim ownership. However, you grant us a limited license to process your content solely to provide the Service.Your scan content is deleted immediately after analysis.

6.3 DMCA Compliance

If you believe content on AI AWARE™ infringes your copyright, contact us at legal@aiawareapp.com with details of the alleged infringement.

7. Disclaimers and Limitations

7.1 No Warranty - "AS IS"

Important: AI AWARE™ is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 Accuracy Limitations

AI detection is not 100% accurate. Results are probabilistic and should be used as guidance, not absolute truth. Factors affecting accuracy include:

• Evolving AI technology that may evade detection
• Quality and context of submitted content
• False positives (flagging human content as AI)
• False negatives (missing AI-generated content)

Always use your own judgment. Do not make critical decisions based solely on AI AWARE™ results.

7.3 Not Professional Advice

AI AWARE™ does not provide legal, financial, medical, or professional advice. Results should not be used as the sole basis for important decisions. Consult qualified professionals when needed.

7.4 Service Availability

We do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance, updates, or technical issues beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability is limited to the amount you paid us in the past 12 months (or $100, whichever is greater)
• We are not liable for losses resulting from:
  • Reliance on AI detection results
  • Service interruptions or errors
  • Data loss or security breaches
  • Third-party actions or content

Some jurisdictions do not allow limitation of liability, so these limits may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless AI AWARE™, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit to the Service

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

10.2 Informal Resolution

Before filing a claim, you agree to contact us at legal@aiawareapp.com to attempt informal resolution. We'll work in good faith to resolve disputes within 60 days.

10.3 Arbitration (Optional)

If informal resolution fails, disputes may be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), rather than in court.

Class Action Waiver: You agree to resolve disputes individually, not as part of a class action or representative proceeding.

You may opt out of arbitration within 30 days of account creation by emailing legal@aiawareapp.com.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via:

• Email notification (at least 30 days notice)
• In-app notification
• Updated "Last updated" date at the top

Continued use of the Service after changes constitutes acceptance of the updated Terms. If you disagree with changes, you must stop using the Service and cancel your account.

12. Termination

12.1 By You

You may terminate your account at any time by:

• Cancelling your subscription through Settings
• Contacting support at privacy@aiawareapp.com

12.2 By Us

We may terminate or suspend your account immediately if:

• You violate these Terms
• Your use poses a security risk
• You engage in fraudulent activity
• Required by law

12.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data (see Privacy Policy for retention)
• Provisions regarding intellectual property, disclaimers, and liability survive termination

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and AI AWARE™.

13.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

13.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

13.5 Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, network failures, etc.).
